The U.S. government has offered a plea deal for the hacker who hacked into the SEC’s X account to publish the approval of the Bitcoin spot ETF

On February 10, Cointelegraph reported that the U.S. government has offered a plea deal for Eric Council Jr., who allegedly helped hack into the U.S. Securities and Exchange Commission’s (SEC) X account in January 2024.

In a document filed on February 9, 2025 with the U.S. District Court for the District of Columbia, federal prosecutors proposed a forfeiture order requiring him to pay $50,000, which he “personally obtained” for posting a message on X that suggested the SEC’s first approval of a Bitcoin spot ETF. The alleged hacker will also plead guilty to one count of conspiracy involving aggravated identity theft and access device fraud.

Council was a member of a group that temporarily took control of the SEC’s X account in January 2024 through a SIM swap attack. The breach allowed hackers to publish a fake message containing an image of then-SEC Chairman Gary Gensler announcing the approval of a spot Bitcoin ETF.
